These Terms & Conditions apply to all orders placed on our website. Please read them carefully before placing an order.

All references to “we”, “us”, “our”, or “the website” refer to The Cornish Chocolate Company.
“You” or “your” refers to the individual or organisation placing an order.

We reserve the right to update or amend these Terms & Conditions at any time. It is your responsibility to review them before ordering.


2. Orders

All orders placed through our website are considered an offer to purchase.

An automated order confirmation email will be sent once your order is received. A contract is formed upon this confirmation.

If you do not receive the confirmation email, please contact us, as your order may not have been processed.

If an item becomes unavailable, we will inform you to arrange a refund, replacement, or alternative.


3. Cancellation of Orders

For non-customised goods, you have the right under the Consumer Contracts Regulations to cancel your order within 14 days of receiving your items.

Returned goods must be:

  • unopened,
  • in original packaging,
  • in resaleable condition.

Return postage costs are the responsibility of the customer.


4. Pricing

Prices shown on the website include VAT where applicable.

The price at the time of ordering is the price you will be charged. Prices may change, and updates will be reflected on the website.

We do not currently ship international orders!


5. Payments

We accept major debit and credit cards, and other payment methods displayed at checkout.

All payments are processed securely through our approved payment provider.


6. Delivery

Delivery charges are clearly stated during checkout and vary depending on location.

Orders are normally packed and dispatched within 48 hours, but processing times may be longer during busy seasons.

Delivery times shown on the website are estimates only and not guaranteed.
We are not responsible for delays caused by postal or courier services.

Customers must ensure that delivery addresses are complete and correct. We cannot be held liable for lost parcels due to incorrect details.


7. Returns & Our Liability

Returns (non-customised items only):

Items may be returned within 30 days if unopened and in original condition.
Return postage costs lie with the customer.
Refunds are issued once items are inspected.

Faulty or damaged items:

If a product has a clear manufacturing fault, we will replace or refund it at no cost to you.

We are not liable for:

  • indirect or consequential losses,
  • loss of income or profits,
  • third-party claims,
  • damage caused by improper storage of chocolate (e.g., melting due to heat).

Your statutory rights are not affected.


8. Allergy & Food Safety Information

Our products are made using ingredients including (but not limited to) milk, soy, nuts, peanuts, gluten, and other allergens.
Full ingredient and allergen information is listed on each product page and packaging.

Despite best manufacturing practices, cross-contamination may occur, and therefore our products are not suitable for people with severe allergies.

If you have specific dietary requirements, please contact us before placing an order.


9. GDPR & Privacy Policy

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR).

Data Collection & Use

We collect only the information necessary to:

  • process and fulfil your order,
  • communicate with you regarding your purchase,

  • delivery companies for order fulfilment.

10. Wholesale & Corporate Orders

We offer wholesale pricing, custom orders, and corporate gifting options.

For wholesale, trade, or corporate enquiries:

  • Minimum order quantities may apply.
  • Delivery times and pricing will be confirmed at the point of order.
  • Custom or branded items are non-refundable once approved and produced.

11. Complaints

If you wish to make a complaint, please email us with full details.
We aim to investigate and respond within 14 working days.

12. Governing Law

Only regular priced items may be refunded. Sale items cannot be refunded.

Exchanges

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at info@cornishchocolates.com and send your item to: Breanoc House, St Agnes, TR5 0NW

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return.

Shipping returns

To return your product, you should mail your product to: Breanoc House, St Agnes. TR5 0NW

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
